In a trio of cases -- Altitude Express Inc. v. Zarda, Bostock v. Clayton County, and R.G. & G.R. Harris Funeral Homes v. EEOC -- the U.S. Supreme Court is set to decide whether Title VII’s prohibition on sex discrimination bars discrimination based on an employee’s sexual orientation or gender identity. These decisions are expected to be issued near the end of the Supreme Court’s term in June, shortly before our panel meets to discuss them.
