Over the past 30 years, mass tort litigation such as asbestos and products liability cases, have been resolved via bankruptcy. More recently, cases involving wildfire damage (PG&E) and sexual misconduct (Boy Scouts, USA Gymnastics) have found their way into bankruptcy courts as well. We will take a look at the unique mechanisms under bankruptcy law that allow resolution of mass tort cases. We will also discuss how the pandemic may present legal issues and challenges that could end up in bankruptcy court.
