Taking a closer look at conditions of probation or supervised release from the perspective of the court, the prosecution, and the defense.
Probation conditions often get little or no attention at sentencing but have been getting recent attention on appeal. This program will help trial lawyers focus on what objections to make and when to make them, and appellate lawyers understand the process in the trial court and how to attack unchallenged conditions on appeal. We’ll discuss both state and federal law and practice.
Topics• A roundup of the types of objections that are having success
• Insight into how the court thinks about probation conditions
• Making the record and negotiating at sentencing
• Tips for raising objections on appeal, even if not raised below
