DiscussionIn April 2018, the U.S. Supreme Court issued a decision in Jesner v. Arab Bank, PLC, addressing the liability of foreign corporations under the Alien Tort Statute. The following month, in May 2018, the Court issued an "epic" decision in Epic Systems v. Lewis, addressing a key concern for companies in the U.S. and around the globe -- the potential exposure from employee class action lawsuits.
This seminar will discuss the Epic Systems ruling upholding class action waivers in employee arbitration agreements and the Jesner case holing that the Alien Tort Statue does not permit lawsuits against foreign corporations.
